REGLAS GENERALES

 

El “Kursaal Channel” (KC) es un canal online de películas clásificadas por tipos y temáticas, para facilitar su localización y disfrute por los espectadores. Además sirve para ayudar a monetizar a los creadores desde youtube y vimeo.

Kursaal Channel se enmarca dentro de los objetivos de Kursaal Film Festival San Sebastián (KFFSS)  de poner en valor el talento de los cineastas, pero no solo durante el Festival sino durante todo el año mediante un sistema de exhibición continuada.

​

Al inscribir una película en el Kursaal Channel el cineasta acepta al cumplimiento de las siguientes

 

BASES DE INSCRIPCIÓN

​

1/.- REQUISITOS GENERALES DE INSCRIPCIÓN

• El tipo y género de las películas es libre, catalogado con estas etiquetas:
  - Ficción/ Animación/ Documental
  - Acción/ Comedia/ Danza/ Derechos Humanos/ Drama/ Experimental/ Horror/  Infantil/ Musical/ Romántica/ Scifi/ Sports/ Thriller/

• La duración de la película es libre: cortometraje(<30min.), mediometraje(30<60min.) y largometraje(60<min.).

• Las películas deben estar instaladas en plataformas de streaming como Vimeo (con clave de acceso) o Youtube, accesibles sin restricciones de edad y con la opción de inserción habilitada.

• Idiomas: Las películas en un idioma distinto del español deberán tener obligatoriamente subtítulos en español, en formato SRT seleccionables, preferiblemente no insertados en el video.

• La película debe ser inscrita por el director, el productor o por los titulares representantes legales de la distribución del cortometraje (en adelante cineasta), que deberá disponer de los derechos sobre los contenidos de la obra y el resto de materiales que aporte.

• Deberán ser obras artísticas originales.

• Se admiten obras de cualquier país.

• Fecha límite de producción: No hay limitación.

• Número máximo de obras por cada autor: No hay limitación.

• Calidad: las películas serán evaluadas por el comité de calidad antes de ser aceptadas en el catálogo del Kursaal Channel.

 

2/.- EVALUACIÓN y COMITÉ DE CALIDAD

​El Comité de Calidad del Kursaal Channel estará formado por miembros del equipo de producción del KFFSS que evaluará las películas que pasarán a formar parte del catálogo del Kursaal Channel.

​

El Comité de Calidad evaluará las películas desde varios puntos de vista:
- Cinematográficos : guion, dirección, producción, interpretación, fotografía, música, sonido, arte, etc.
- Éticos y legales : evaluando que el contenido no sea ofensivo, ni vulnere derechos y libertades.

​

Kursaal Channel se reserva en todo momento el derecho a corregir los datos de inscripción, modificar las etiquetas de clasificación o incluso eliminar del catálogo las películas que incumplen los requisitos.

3/.- PROCESO INSCRIPCIÓN y SELECCIÓN
1º.- Inscripción de la película en Kursaal Channel rellenando el formulario online.
2º.- El cineasta deberá proceder al pago de la tasa de inscripción.
3º.- KC comunicará al cineasta la aprobación para su publicación en el catálogo.

4/.- MONETIZACIÓN DE LAS PELÍCULAS
Las películas inscritas en el Kursaal Channel (KC) pueden estar instaladas en servicios de streaming, como Youtube o Vimeo, donde tengan habilitada la opción de monetización.

6/.- GARANTÍAS Y RESPONSABILIDADES DE LOS PARTICIPANTES.

​Con el fin de que se respeten los derechos de terceros y de evitar situaciones anómalas en el Kursaal Channel (KC), se comunica que:

​

6.a).- PROTECCION DE MENORES. KC es un canal online orientado a un público adulto ( mayores de edad legal  o 18 años ), por lo que KC y KFFSS no puede controlar el acceso de personas menores de edad. Por ello, KC y KFFSS no pueden admitir responsabilidad alguna al respecto, advirtiendo que serán los padres y tutores los únicos responsables de controlar y asistir a los menores en la navegación por las páginas de KC, y serán así mismo responsables de habilitar cualesquiera otros mecanismos necesarios que, en su caso, impidan el acceso por parte de los menores, no admitiendo KC y  KFFSS  ninguna responsabilidad ni reclamación al respecto.

6.b).- CONTENIDO DE LAS PELÍCULAS.  Los cineastas que inscriban una película en el KC deberá disponer de  todos los derechos de propiedad intelectual (video, música, guion, etc), derechos de imagen y de distribución pública por cualquier medio necesarios para ello,  serán los únicos responsables legales del contenido del mismo, responderán de su contenido y de cuantas declaraciones, obligaciones y responsabilidades se asumen por el hecho de la participación de conformidad con las bases recogidas en este documento.  Las películas no pueden contener ningún tipo de material ilícito, ni pornográfico, ni que atente a cualquier derecho de tercero.  El cineasta participante será el único y exclusivo responsable de las reclamaciones que reciba KC o KFFSS por este motivo, eximiendo a estas de toda responsabilidad que se derive de su utilización y asumiendo las responsabilidades económicas o de otra índole que pudieran derivarse.

6.c).- AUTORIZACIÓN DE LAS PELÍCULAS.   La inscripción en el KC supone la autorización gratuita por parte de los cineastas, sin limitación territorial alguna y por tiempo indefinido hasta que se solicite la baja, para la difusión publicitaria de las películas incluida la autoría. El resto de datos personales y de contacto registrados en el KC quedan reservados para conocimiento interno y de gestión por parte de KC y KFFSS.

7/.- DARSE DE BAJA.

​En cualquier momento el cineasta que tenga inscrita una película en el Kursaal Channel podrá solicitar la baja temporal o definitiva, siempre que se haga desde la misma dirección de email desde la que se solicitó el alta.

​

8/.- VARIOS.

​En caso de traducción de las presentes Bases  a cualquier otro idioma, siempre prevalecerá la versión en idioma español.

​

El responsable de los datos personales que se faciliten como consecuencia de la participación en el KC es KFFSS  que los tratarán de conformidad con la normativa aplicable en España y según la política de privacidad del KC,  que también puedes encontrar tanto en las fichas de inscripción al KC como en un enlace permanente al pie de nuestra página web.

Para toda cuestión litigiosa que pudiera dimanar de las presentes Bases, los cineastas inscritos hacen expresa renuncia a cualquier fuero que pudiera corresponderles, y expresamente se someten a los Juzgados y Tribunales de la ciudad de San Sebastián (España).

​

EL HECHO DE PARTICIPAR EL KURSAAL CHANNEL (KC) SUPONE LA TOTAL ACEPTACIÓN DE ESTAS BASES. EN CASO DE SITUACIONES NO PREVISTAS KC DECIDIRÁ EN CADA MOMENTO.

GENERAL RULES

​

The "Kursaal Channel" (KC) is an online channel for films categorized by type and theme, making them easier for viewers to locate and enjoy. It also helps creators monetize their work on YouTube and Vimeo.

​

The Kursaal Channel is part of the Kursaal Film Festival San Sebastián (KFFSS)'s objectives of showcasing the talent of filmmakers, not only during the Festival but throughout the year through a continuous screening system.

​

By submitting a film to the Kursaal Channel, the filmmaker agrees to comply with the following

​

REGISTRATION RULES

​

1.- GENERAL REGISTRATION REQUIREMENTS

- The type and genre of films are freely selectable, categorized with the following tags:
   + Fiction / Animation / Documentary
   + Action / Comedy / Dance / Human Rights / Drama / Experimental / Horror / Children's / Musical / Romance / Sci-Fi / Sports / Thriller
- The length of the film is freely selectable: short film (<30 min.), medium-length film (30 <60 min.), and feature film (60 <60 min.).
- Films must be uploaded to streaming platforms such as Vimeo (with an access key) or YouTube, accessible without age restrictions and with the embedding option enabled.
- Languages: Films in a language other than Spanish must have Spanish subtitles, in selectable SRT format, preferably not embedded in the video.
- The film must be submitted by the director, producer, or the legal representative of the short film's distribution (hereinafter "filmmaker"), who must hold the rights to the work's content and any other materials provided.
- They must be original artistic works.
- Works from any country are accepted.
- Production deadline: No limit.
- Maximum number of works per author: No limit.
 

Quality: Films will be evaluated by the Quality Committee before being accepted into the Kursaal Channel catalog.

2.- EVALUATION and QUALITY COMMITTEE

The Kursaal Channel Quality Committee will be made up of members of the KFFSS production team who will evaluate the films that will become part of the Kursaal Channel catalog.

​

The Quality Committee will evaluate the films from several perspectives:
- Cinematographic: script, direction, production, acting, photography, music, sound, art, etc.
- Ethical and legal: assessing that the content is not offensive or violates rights and freedoms.

​

Kursaal Channel reserves the right at all times to correct the registration information, modify the rating labels, or even remove films that do not meet the requirements from the catalog.

​

3.- REGISTRATION AND SELECTION PROCESS

1.- Submit the film to Kursaal Channel by completing the online form.
2.- The filmmaker must pay the registration fee.
3.- KC will notify the filmmaker of approval for publication in the catalog.

4/.- MONETIZATION OF FILM

Films submitted to the Kursaal Channel (KC) can be uploaded to streaming services, such as YouTube or Vimeo, where monetization is enabled.

6/.- WARRANTIES AND LIABILITIES OF PARTICIPANTS

In order to respect the rights of third parties and avoid abnormal situations on the Kursaal Channel (KC), we hereby inform you that:

​

6.a) PROTECTION OF MINORS. KC is an online channel aimed at an adult audience (those of legal age or 18 years of age), so KC and KFFSS cannot control access by minors. Therefore, KC and KFFSS cannot accept any liability in this regard. It is noted that parents and guardians are solely responsible for supervising and assisting minors when browsing the KC pages. They will also be responsible for enabling any other necessary mechanisms that, where appropriate, prevent access by minors. KC and KFFSS accept no liability or claim in this regard.

 

6.b).- CONTENT OF THE FILM. Filmmakers who submit a film to the KC must have all intellectual property rights (video, music, script, etc.), image rights, and public distribution rights by any means necessary. They will be solely legally responsible for its content and will be liable for its content and for any statements, obligations, and responsibilities assumed by participation in accordance with the rules set forth in this document. Films may not contain any type of illicit or pornographic material, nor any material that infringes any third-party rights. The participating filmmaker will be solely and exclusively responsible for any claims received by KC or KFFSS for this reason, exempting them from any liability arising from their use and assuming any financial or other responsibilities that may arise.

6.c).- AUTHORIZATION OF THE FILMS. Registration with the KC grants filmmakers free authorization, without any territorial restrictions and for an indefinite period until deregistration is requested, for the publicity distribution of films, including authorship. All other personal and contact information registered with the KC is reserved for internal information and management by KC and KFFSS.

7/.- UNSUBSCRIBE.

At any time, filmmakers who have registered a film with the Kursaal Channel may request temporary or permanent deregistration, provided that they do so from the same email address from which they requested registration.

​

8/.- MISCELLANEOUS.

In the event that these Terms and Conditions are translated into any other language, the Spanish version will always prevail.

​

The KFFSS is responsible for any personal data provided as a result of participating in the KC. These data will be processed in accordance with applicable Spanish regulations and the KC's privacy policy, which can also be found on the KC registration forms and via a permanent link at the bottom of our website.

​

For any dispute arising from these Rules, the registered filmmakers expressly waive any other jurisdiction to which they may be entitled and expressly submit to the jurisdiction of the Courts and Tribunals of the city of San Sebastián (Spain).

​

PARTICIPATING IN THE KURSAAL CHANNEL (KC) IMPLIES FULL ACCEPTANCE OF THESE RULES. IN THE EVENT OF UNFORESEEN SITUATIONS, KC WILL DECIDE AT ALL TIMES.
