REGLAS GENERALES

 

El “Kursaal Channel” (KC) es un canal online de películas clásificadas por tipos y temáticas, para facilitar su localización y disfrute por los espectadores. Además sirve para ayudar a monetizar a los creadores desde youtube y vimeo.

Kursaal Channel se enmarca dentro de los objetivos de la Asociación Kursaal Kino (A2K)  de poner en valor el talento de los cineastas, pero no solo durante el Kursaal Film Festival San Sebastián (KFFSS), sino durante todo el año mediante un sistema de exhibición continuada.

​

Al inscribir una película en el Kursaal Channel el cineasta acepta al cumplimiento de las siguientes

 

BASES DE INSCRIPCIÓN

​

1/.- REQUISITOS GENERALES DE INSCRIPCIÓN

​

• El tipo y género de las películas es libre, catalogado con estas etiquetas:
  - Ficción/ Animación/ Documental
  - Acción/ Comedia/ Danza/ Derechos Humanos/ Drama/ Experimental/ Horror/  Infantil/ Musical/ Romántica/ Scifi/ Sports/ Thriller/

• La duración de la película es libre: cortometraje(<30min.), mediometraje(30<60min.) y largometraje(60<min.).

• Las películas deben estar instaladas en plataformas de streaming como Vimeo (con clave de acceso) o Youtube, accesibles sin restricciones de edad y con la opción de inserción habilitada.

• Idiomas: Las películas en un idioma distinto del español deberán tener obligatoriamente subtítulos en español, en formato SRT seleccionables, preferiblemente no insertados en el video.

• La película debe ser inscrita por el director, el productor o por los titulares representantes legales de la distribución del cortometraje (en adelante cineasta), que deberá disponer de los derechos sobre los contenidos de la obra y el resto de materiales que aporte.

• Deberán ser obras artísticas originales, quedando excluidas las meras reproducciones de acontecimientos de cualquier índole y aquellas de carácter publicitario.

• Se admiten obras de cualquier país.

• Fecha límite de producción: No hay limitación.

• Número máximo de obras por cada autor: No hay limitación.

• Calidad: las películas serán evaluadas por el comité de calidad antes de ser aceptadas en el catálogo del Kursaal Channel.

 

2/.- EVALUACIÓN y COMITÉ DE CALIDAD

El Comité de Calidad del Kursaal Channel estará formado por miembros de la Asociación Kursaal Kino (A2K) que evaluará las películas que pasarán a formar parte del catálogo del Kursaal Channel.

​

El Comité de Calidad evaluará las películas desde varios puntos de vista:
- Cinematográficos : guion, dirección, producción, interpretación, fotografía, música, sonido, arte, etc.
- Éticos y legales : evaluando que el contenido no sea ofensivo, ni vulnere derechos y libertades.

​

Kursaal Channel se reserva en todo momento el derecho a corregir los datos de inscripción, modificar las etiquetas de clasificación o incluso eliminar del catálogo las películas que considere oportuno.

3/.- PROCESO INSCRIPCIÓN y SELECCIÓN

1º.- Inscripción de la película en Kursaal Channel rellenando el formulario online.
2º.- Revisión errores y evaluación de calidad del contenido de la película.
3º.- KC comunicará al cineasta la aprobación para su publicación en el catálogo.
4º.- Una vez aprobada la inclusión en el catálogo de KC el cineasta se compromete a mantener accesible su película hasta que voluntariamente decida darse baja del KC.

Para inscribir la película en el KC recomendamos a los cineastas tener preparada una presentación suya con tres elementos básicos:
a/.- Fotografía del director/a con la persona centrada en primer plano, formato retrato.
b/.- Video del director/a con una presentación suya y de la película (3 minutos max.).
c/.- Video del trailer de la película.
d/.- Video con el making of de la película.

Estos tres video pueden estar en Youtube o Vimeo, accesibles al público, sin restricciones de edad y con la opción de inserción habilitada.

4/.- MONETIZACIÓN DE LAS PELÍCULAS

Las películas inscritas en el Kursaal Channel pueden estar instaladas en servicios de streaming, como Youtube o Vimeo, donde tengan habilitada la opción de monetización.

6/.- GARANTÍAS Y RESPONSABILIDADES DE LOS PARTICIPANTES.

Con el fin de que se respeten los derechos de terceros y de evitar situaciones anómalas en el Kursaal Channel (KC), se comunica que:

​

6.a).- PROTECCION DE MENORES. KC es un canal online orientado a un público adulto ( mayores de edad legal  o 18 años ), por lo que KC y A2K no puede controlar el acceso de personas menores de edad. Por ello, KC y A2K no pueden admitir responsabilidad alguna al respecto, advirtiendo que serán los padres y tutores los únicos responsables de controlar y asistir a los menores en la navegación por las páginas de KC, y serán así mismo responsables de habilitar cualesquiera otros mecanismos necesarios que, en su caso, impidan el acceso por parte de los menores, no admitiendo KC y A2K  ninguna responsabilidad ni reclamación al respecto.

6.b).- CONTENIDO DE LAS PELÍCULAS.  Los cineastas que inscriban una película en el KC deberá disponer de  todos los derechos de propiedad intelectual (video, música, guion, etc), derechos de imagen y de distribución pública por cualquier medio necesarios para ello,  serán los únicos responsables legales del contenido del mismo, responderán de su contenido y de cuantas declaraciones, obligaciones y responsabilidades se asumen por el hecho de la participación de conformidad con las bases recogidas en este documento.  Las películas no pueden contener ningún tipo de material ilícito, ni pornográfico, ni que atente a cualquier derecho de tercero.  El cineasta participante será el único y exclusivo responsable de las reclamaciones que reciba KC o A2K por este motivo, eximiendo a estas de toda responsabilidad que se derive de su utilización y asumiendo las responsabilidades económicas o de otra índole que pudieran derivarse.

6.c).- AUTORIZACIÓN DE LAS PELÍCULAS.   La inscripción en el KC supone la autorización gratuita por parte de los cineastas, sin limitación territorial alguna y por tiempo indefinido hasta que se solicite la baja, para la difusión publicitaria de las películas incluida la autoría. El resto de datos personales y de contacto registrados en el KC quedan reservados para conocimiento interno y de gestión por parte de KC y A2K.

7/.- DARSE DE BAJA.

​

En cualquier momento el cineasta que tenga inscrita una película en el Kursaal Channel podrá solicitar la baja temporal o definitiva, siempre que se haga desde la misma dirección de email desde la que se solicitó el alta.

​

8/.- VARIOS.

​

En caso de traducción de las presentes Bases  a cualquier otro idioma, siempre prevalecerá la versión en idioma español.

​

El responsable de los datos personales que se faciliten como consecuencia de la participación en el KC es A2K  que los tratarán de conformidad con la normativa aplicable en España y según la política de privacidad del KC,  que también puedes encontrar tanto en las fichas de inscripción al KC como en un enlace permanente al pie de nuestra página web.

​

Para toda cuestión litigiosa que pudiera dimanar de las presentes Bases, los cineastas inscritos hacen expresa renuncia a cualquier fuero que pudiera corresponderles, y expresamente se someten a los Juzgados y Tribunales de la ciudad de San Sebastián (España).

​

EL HECHO DE PARTICIPAR EL KURSAAL CHANNEL (KC) SUPONE LA TOTAL ACEPTACIÓN DE ESTAS BASES. EN CASO DE SITUACIONES NO PREVISTAS KC DECIDIRÁ EN CADA MOMENTO.

GENERAL RULES

​

The “Kursaal Channel” (KC) is an online channel of films classified by type and theme, to facilitate their location and enjoyment by viewers. It also serves to help monetize creators from YouTube and Vimeo.

​

Kursaal Channel is part of the objectives of the Kursaal Kino Association (A2K) to value the talent of filmmakers, but not only during the Kursaal Film Festival San Sebastián (KFFSS), but throughout the year through a continuous exhibition system.

​

By registering a film on the Kursaal Channel, the filmmaker agrees to comply with the following

​

RULES OF PARTICIPATION

​

1/.- GENERAL REGISTRATION REQUIREMENTS

​

• The type and genre of the films is free, categorized with these tags:
- Fiction/ Animation/ Documentary
- Action/ Comedy/ Dance/ Human Rights/ Drama/ Experimental/ Horror/ Children's/ Musical/ Romantic/ Sci-Fi/ Sports/ Thriller/

• The length of the film is free: short film (<30min.), medium-length film (30<60min.) and feature film (60<min.).
• The films must be installed on streaming platforms such as Vimeo (with access code) or Youtube, accessible without age restrictions and with the insertion option enabled.
• Languages: Films in a language other than Spanish must have Spanish subtitles, in selectable SRT format, preferably not inserted in the video.
• The film must be entered by the director, producer or legal representative of the short film distributor (hereinafter referred to as the filmmaker), who must have the rights to the content of the work and any other materials provided.
• The films must be original artistic works, excluding mere reproductions of events of any kind and those of an advertising nature.
• Works from any country are accepted.
• Production deadline: No limit.
• Maximum number of works by each author: No limit.
• Quality: the films will be evaluated by the quality committee before being accepted into the Kursaal Channel catalogue.

2/.- EVALUATION and QUALITY COMMITTEE

​

The Kursaal Channel Quality Committee will be made up of members of the Kursaal Kino Association (A2K) who will evaluate the films that will become part of the Kursaal Channel catalogue.

​

The Quality Committee will evaluate the films from various points of view:
- Cinematographic: script, direction, production, acting, photography, music, sound, art, etc.
- Ethical and legal: evaluating that the content is not offensive, nor does it violate rights and freedoms.

​

Kursaal Channel reserves the right at all times to correct the registration data, modify the classification labels or even remove the films it deems appropriate from the catalogue.

3/.- REGISTRATION and SELECTION PROCESS

​

1º.- Registration of the film on Kursaal Channel by filling out the online form.
2º.- Review of errors and evaluation of the quality of the film's content.
3º.- KC will inform the filmmaker of the approval for publication in the catalogue.
4º.- Once the inclusion in the KC catalogue has been approved, the filmmaker agrees to keep his/her film accessible until he/she voluntarily decides to withdraw from the KC.

To register the film in the KC, we recommend that filmmakers prepare a presentation of themselves with three basic elements:
a/.- Photograph of the director with the person centred in the foreground, portrait format.
b/.- Video of the director with a presentation of himself/herself and of the film (3 minutes max.).
c/.- Video of the film trailer.
d/.- Video with the making of the film.

These three videos can be on Youtube or Vimeo, accessible to the public, without age restrictions and with the insertion option enabled.

4/.- MONETIZATION OF FILMS

​

Films registered on the Kursaal Channel may be installed on streaming services, such as YouTube or Vimeo, where the monetization option is enabled.

6/.- WARRANTIES AND RESPONSIBILITIES OF PARTICIPANTS.

​

In order to ensure that the rights of third parties are respected and to avoid anomalous situations on the Kursaal Channel (KC), it is hereby communicated that:

6.a).- PROTECTION OF MINORS. KC is an online channel aimed at an adult audience (of legal age or 18 years old), therefore KC and A2K cannot control the access of minors. Therefore, KC and A2K cannot accept any liability in this regard, warning that parents and guardians will be the only ones responsible for controlling and assisting minors in browsing the KC pages, and will also be responsible for enabling any other necessary mechanisms that, where appropriate, prevent access by minors, KC and A2K not accepting any liability or claim in this regard.

 

6.b).- CONTENT OF THE FILMS. Filmmakers who register a film in the KC must have all intellectual property rights (video, music, script, etc.), image rights and public distribution rights by any means necessary for this, they will be the only legal responsible for the content of the same, they will be responsible for its content and for any statements, obligations and responsibilities assumed by the fact of participation in accordance with the bases included in this document. The films cannot contain any type of illicit or pornographic material, or that violates any third party rights. The participating filmmaker will be the sole and exclusive party responsible for any claims received by KC or A2K for this reason, exempting them from any liability arising from their use and assuming any financial or other responsibilities that may arise.

6.c).- AUTHORIZATION OF FILMS. Registration in the KC implies free authorization by the filmmakers, without any territorial limitation and for an indefinite period until the withdrawal is requested, for the advertising dissemination of the films, including the authorship. The rest of the personal and contact data registered in the KC are reserved for internal knowledge and management by KC and A2K.

 

7/.- UNSUBSCRIBE.

​

At any time, the filmmaker who has a film registered in the Kursaal Channel may request temporary or permanent withdrawal, provided that it is done from the same email address from which the registration was requested.

 

8/.- MISCELLANEOUS.

​

In the event of translation of these Rules into any other language, the Spanish version will always prevail.

​

The party responsible for the personal data provided as a result of participation in the KC is A2K, which will process them in accordance with the regulations applicable in Spain and according to the KC privacy policy, which you can also find in the KC registration forms and in a permanent link at the bottom of our website.

​

For any litigious issue that may arise from these Rules, the registered filmmakers expressly waive any jurisdiction that may apply to them, and expressly submit to the Courts and Tribunals of the city of San Sebastián (Spain).

​

PARTICIPATING IN THE KURSAAL CHANNEL (KC) MEANS FULL ACCEPTANCE OF THESE RULES. IN THE CASE OF UNFORESEEN SITUATIONS, KC WILL DECIDE AT ALL TIMES.
